Terms and Conditions of Service

1. Introduction

Welcome to the Fire-IT website and services! By accessing or using our website and services, you agree to comply with these Terms & Conditions. If you do not agree with these terms, please refrain from using our website and services.

Fire-IT offers a range of IT support services, including system maintenance, network support, backups, software installation, troubleshooting, internet, VoIP, and cybersecurity. The scope of services will be defined in the agreement or quotation provided to you.

2. Payment & Invoicing

  • Payment Terms: Payment for services is due as per the agreed terms in the quotation or service contract.
  • Invoice Settlement: All invoices must be settled within 5 days, unless otherwise stated in the agreement. Late payments may incur additional fees or interest charges.
  • Deposit Requirement: A deposit of 80% of the total quoted amount is due immediately upon acceptance of the quote. No work will commence until the deposit is received and confirmed.
  • Bank Transfer: Payments are due via bank transfer. Payment details will be provided upon request.
  • Router Charges: If any routers are supplied and not returned upon cancellation, a charge of R1500.00 per router will apply.

3. Liability & Indemnity

  • Limitation of Liability: Fire-IT is not liable for any indirect, incidental, or consequential damages arising from the use of our services, including loss of business, data, or profits.
  • Indemnity: You agree to indemnify and hold harmless Fire-IT, its employees, contractors, and affiliates from any claims, losses, or damages arising from your use of our services. This includes, but is not limited to, issues caused by third-party software or systems integrated with your IT infrastructure.

4. Service Availability

Fire-IT will make reasonable efforts to provide timely support. However, we are not responsible for service interruptions or delays due to factors outside our control, including third-party service outages or hardware failures.

5. Data Protection & Security

  • Compliance with POPIA: Fire-IT is committed to protecting your personal and business data in compliance with the Protection of Personal Information Act (POPIA).
  • Client Responsibility: You are responsible for maintaining the security of your IT systems, and Fire-IT will assist in securing systems but is not liable for breaches or unauthorized access that occurs beyond our reasonable control.

6. Termination

  • Termination by Either Party: Either party may terminate the services upon written notice once the contract term has expired. Upon termination, any outstanding invoices must be paid in full.
  • Effect of Termination: All services will cease upon termination, but any outstanding payments for services rendered up to the termination date remain due.

7. Confidentiality

Both Fire-IT and the client agree to maintain the confidentiality of all sensitive information shared during the course of providing IT support services. This information will be used solely for the purpose of providing or receiving services and will not be disclosed to third parties without prior consent, except as required by law.

8. Governing Law

These Terms & Conditions are governed by the laws of South Africa. Any disputes arising under these terms shall be resolved in accordance with South African law, and you agree to submit to the exclusive jurisdiction of South African courts.

9. Changes to Terms

Fire-IT reserves the right to amend these Terms & Conditions at any time. Any changes will be posted on this page, and the revised version will be effective immediately upon posting. Continued use of our services after any modifications constitutes acceptance of the updated terms.
